Wine should be inspected immediately upon receipt. Any missing cases from a consignment or any damage should be notified to the carrier at the time of delivery and notified to us within 24 hours. Non-delivery of a complete order with an agreed delivery date must be notified to us within three days of the non-delivery.

8. Title
We shall retain title to the wines sold by us until all the sums due from you in respect of any order have been paid. We will therefore be entitled to retain possession of any wine to which you would otherwise be entitled and this may mean that some deliveries are held pending resolution. If you are in possession of the wine before we receive cleared funds then you will hold it as our trustee and keep it separate and apart from your own goods, keeping it properly insured and stored. If payment in full is not made we will be entitled to seek the return of the wine from you or from any third party where the wine is being stored.

9. Default
If payment is overdue, then 28 days after the due date and, having given you written notice to this effect, we will have the right to sell the wines and apply the proceeds to the overdue payment but this will not in any way affect your statutory rights.

We cannot be held responsible for failing to meet our obligations a result of an act of God, war, strike, lockout, labour disputes, fire, flood, drought or any other circumstances beyond our control.

11. Description/Quality

Due to the increasing trend of 75cl bottles being packed as 6 x 75cl, a delivery of 2 x 6 x 75cl will satisfy an order for 12 x 75cl. We will act in good faith when selling wines but we cannot guarantee the state and condition of wines or whether they correspond to the qualities which might be expected from their description.

12. Law
All our agreements are made under the laws of England and are subject to the jurisdiction of the English courts. The statutory rights of the consumer are not affected by these terms and conditions.
